1. Scope of service AAA All Seasons Wildlife Control Inc. (“ASWCI”) performs humane wildlife removal services, with respect to raccoons, squirrels, skunks, opossums, pigeons and other pest birds. In addition, ASWCI removes and visible bee- or wasp nests. 2. Humane service ASWCI does not condone willful or intentional injury or death to wildlife, nor does it remove wildlife from their accustomed range. Ontario provincial law prohibits removal of wildlife beyond a distance of 0.8 kilometers. 3. Acceptance Customer’s acceptance of the terms and conditions set out herein and agreement to pay the applicable service charges shall be deemed to be given by any of the following occurrences:
4. Delivery of service AAA All Seasons Wildlife Control Inc. (“ASWCI”) operates a number of service vehicles in the Greater Toronto Area, including all of 416, most of 905, and parts of 519 and 705 telephone exchanges. Service appointments are generally made within two-hour windows between 8.00 a.m. and 4.00 p.m. Monday to Saturday, including statutory holidays (except Christmas Day). Due to variable conditions such as traffic density, deviation from time estimates of prior service appointments, special equipment requirements, etc. ASWCI does not guarantee strict adherence to scheduled appointment times and reserves the right to re-schedule appointments. 5. Free Estimate ASWCI’s wildlife consultants are available seven days a week, fifty-two weeks a year to answer your questions and queries regarding your wildlife problems. They will provide you with a full description of the wildlife control services offered by ASWCI, including availability, and pricing. They will explain ASWCI’s pricing policy in detail and provide a FREE ESTIMATE on the basis of the information provided by the customer. ASWCI does NOT provide free on-site inspections for residential customers. Our minimum price for an attendance and inspection of residential premises is $125.00 plus G.S.T. 6. Price and payment ASWCI provides its customers with a detailed invoice including itemized pricing. ASWCI requires payment in full upon completion of the initial service appointment, unless credit arrangements have been made and approved in advance. Subsequent service appointments, such as closing our one-way door, or to check on additional issues arising, are made without charge provided charge for the initial service appointment has been paid in full. ASWCI accepts payment by most major credit cards, debit card, cheque or cash. In the event the payment is dishonored by the bank or otherwise reversed, ASWCI charges a minimum administrative fee of $30.00 per payment. 7. Guarantees and warranties ASWCI guarantees all its work for the period of one year from the date of the initial service appointment. This guarantee applies to work done and materials supplied ONLY. ASWCI’s guarantee does not cover additional holes or other damage caused by displaced wildlife. Additional charges apply to additional or extra work, whether this was present at the time of the initial service appointment or results from damage caused subsequently by the displaced wildlife or otherwise. 8. Implied term as to time. One-way doors installed by ASWCI will be retrieved by ASWCI after a period of not less than five days (unless the customer agrees to a shorter period) and replaced by permanent animal-proof screening. Live traps delivered or installed by ASWCI will be serviced (i.e. trapped wildlife removed) for a period of one week only. This service period may be extended upon request by the customer and provided an additional service fee is paid in advance. 9. Items left at customer’s premises remain property of ASWCI One-way doors installed by ASWCI remain the property of ASWCI and the customer is deemed to permit ASWCI personnel to enter onto the subject property to retrieve any one-way doors installed, subject to the resulting opening being screened over permanently at no additional cost. In the event a one-way door is removed by the customer or by third parties, a charge of $150.00 plus G.S.T. per one-way door will apply. Wildlife live traps installed or delivered by ASWCI remain the property of ASWCI and the customer is deemed to permit ASWCI personnel to enter onto the subject property to retrieve any traps, whether or not wildlife has been successfully trapped. In the event a live trap is removed by the customer or by third parties, or otherwise can not be located, a charge of $375. 00 plus G.S.T. per trap will apply. 10. Limitation to scope of service ASWCI does not offer or perform roof-or other repair, whether damage was caused by displaced wildlife, by ASWCI technicians in the scope of their wildlife removal activities, or otherwise. When inspecting or searching the attic space or other unfinished confined space(s) in customer’s premises, ASWCI does not accept responsibility for ceiling damage, however caused. 11, Limitation of liability ASWCI offers humane wildlife removal services only. ASWCI shall not be liable under any circumstances for any special, consequential, incidental or exemplary damages arising out of, or in any way connected with our services provided, including but not limited to damages for lost profit, lost opportunity, lost time, loss of use, loss of data or for any damages of sums paid to third parties. The foregoing limitation of liability shall apply whether a claim is founded in contract, breach of warranty, negligence or any other tort, breach of statutory duty, principles of indemnity or contribution. 12. Terms and Conditions may change without prior notice. ASWCI reserves the right to change the terms and conditions and warranties as set out above at any time without notice. |
